As the medical industry is becoming more dependent on electronic data, Lancet is committed to protecting its policyholders from liabilities arising from the theft, loss or accidental transmission of their patients’ confidential information.
E-Med Features
Network Security and Privacy Insurance (Up to $50,000)
Lancet will pay, on behalf of the insured, the loss and defense costs the insured becomes legally obligated to pay as a result of a claim for a network security wrongful act or privacy wrongful act.
Regulatory Proceedings Insurance (Up to $50,000)
Lancet will reimburse the insured for defense costs, audit expenses and/or regulatory fines and penalties incurred by the insured as a result of regulatory proceedings brought against the insured by a governmental agency.
Patient Notification and Credit Monitoring Cost Insurance (Up to $50,000)
Lancet will pay cost associated with patient notification and credit monitoring costs due to a claim for privacy wrongful acts.
Data Recovery Cost Insurance (Up to 5,000)
Lancet will pay data recovery costs incurred by the insured due to a claim for a data interference act.
Multimedia Liability
Coverage for both online and offline media. Including liability coverage for claims alleging copyright/trademark infringement, libel/slander. Advertising, plagiarism, and personal injury.
Network Security and Privacy Liability
Includes liability coverage for allegations of privacy violations. Coverage is for both online and offline information, virus attacks, denial of service, and failure to prevent transmission of malicious code. Also extends coverage for defense costs and fines/penalties for violations of privacy regulation including but not limited to HIPAA, Red Flags Rule and the new Hi-Tech Act.
Privacy Regulatory Defense and Penalties
Includes reimbursements for Defense Costs, Audit Expenses and/of Regulatory Fines and Penalties incurred by the insured as a result of Regulatory Proceedings.
Privacy Breach Response Costs, Patient Notification Expenses, and Patient Support and Credit Monitoring Expenses
Includes all reasonable legal, public relations, advertising, IT forensic, call center, credit monitoring and postage expenses incurred by the insured for a privacy breach response.
Network Asset Protection
Coverage for all reasonable and necessary sums required to recover and/or replace data that is compromised, damaged, lost, erased or corrupted by non-property perils. Coverage also includes business interruption and extra expense coverage for income loss as a result of the total or partial interruption of the insured’s computer system.
Cyber Extortion
Will pay extortion expenses and extortion monies as a direct result of a credible cyber extortion threat.
Cyber Terrorism
Coverage for income loss and interruption expenses as a result of the total or partial interruption of the insured’s computer system due to a cyber terrorism attack.
Medefense Plus Regulatory Proceedings
Coverage for defense costs, shadow audit expenses, and regulatory fines and penalties resulting from civil investigations or proceedings brought by a government entity or commercial payer alleging erroneous billings, civil investigations or proceedings brought by a qui tam plaintiff under the federal False Claims Act or investigations or proceedings as a result of the Insured’s voluntary self- disclosure to a government entity. Coverage included for EMTALA and Stark Proceedings.
